Navigating the Legal Landscape: Ethical and Regulatory Considerations in AI-Driven Healthcare
摘要
Artificial Intelligence (AI) is gaining prominence in healthcare, promising to enhance the efficiency and quality of medical services. However, this rapid integration of AI in clinical practice brings forth complex medical-legal questions that demand scrutiny. To begin, this study investigates the imperative of establishing a framework of medical law principles to govern AI applications, taking into account the intricate interplay between existing legal statutes and established medical customs and practices. Furthermore, it delves into the legal dimensions of AI adoption in healthcare, encompassing various critical issues. It explores strategies for the optimal implementation of AI in healthcare settings, focusing on the spatial, temporal, and cross-border dynamics of AI operations. The present study also addresses the issue of legal accountability for AI performance, identifying liable parties and proposing mechanisms for ensuring their accountability. Furthermore, it emphasizes the necessity of safeguarding patients’ personal data when employing AI technology, an area currently lacking well-defined regulations. This study underscores the urgency of addressing the legal and ethical challenges associated with the increasing use of AI in healthcare. It advocates for algorithmic transparency, patient privacy protection, and robust cybersecurity measures. As AI options in medicine continue to evolve, healthcare professionals and leaders must navigate this ever-changing medical-legal landscape to ensure the responsible and beneficial integration of AI in clinical practice and facilities.
