The Plaintiff bank loaned RMB4,800,000 to the First Defendant (Hewitt), secured by a mortgage over the ship M.V. “Yue Hui Zhou Huo 9277”, which was jointly owned by the First Defendant (Hewitt) and the Second Defendant (Shiwan), under an agreed mortgage facility with a maximum amount of RMB12,216,100. The loan was jointly and severally guaranteed by the Third Defendant (Yihai) and the Fourth Defendant (YANG Liangjun), to a maximum amount of RMB4,800,000 for a period of three years. The Sixth Defendant (CHEN Aijun) was the Fourth Defendant’s wife; she agreed that her communal property with the Fourth Defendant would be available to satisfy any liability he might incur. Two years later, the Fifth Defendant (CHEN Zhizhao) also agreed to guarantee the loan to a maximum amount of RMB4,800,000, for a period of one year.
