The Shanghai Pudong New District Economy and Trade Bureau gave approval to non-party Huaxia to build the Sanjia Port Waterfront Paradise, also known as the Sanjia Port Bathing Beach. Huaxia contracted with the first Plaintiff (Chaoyi)was the operate and manage the bathing beach. The first Plaintiff contracted with the second Plaintiff (Xiaweiyu) to undertake the daily management of the bathing beach. The two Defendants were engaged in the performance of a silting and enclosure plan as part of a land reclamation project near the bathing beach. The two Plaintiffs sued the two Defendants, alleging that the Defendants’ faulty performance of their tasks had caused clogging of the drainage pipes at the bathing beach, and deterioration in the water quality.
