Applicant Wenzhou Maritime Safety Administration received a report from the public that a ship was found stranded on a submerged dam downstream of a bridge. The ship was loaded with fuel oil, did not carry any certificates, without any identification that could indicate the identity of the ship, and no crew on board. After further investigation by Wenzhou Maritime Safety Administration, the crew and owner of the ship were not found, and the ship in distress did not have any certificate or identification that could show its identity, the ownership of the ship could not be confirmed, and no one claimed ownership of the ship. As a result, an application was made for the property to be recognized as unclaimed. After ascertaining the facts, the court issued a ruling to auction off the unnamed ship and its oil products, and issued a public notice to claim the said property, with the statutory period of one year having expired and the said property being unclaimed. The court held that, where the people’s court accepted an application for the property to be deemed unclaimed and, after examination and verification, issued a public notice of claim for one year, it judged that the property was deemed unclaimed and reverted to the State or the collective.
