Use of the Autonomous Weapon System: Exploration of Its Legality in Nexus with International Humanitarian Law

The widespread deployment of Autonomous Weapon Systems (AWS) in contemporary conflict presents numerous urgent legal and ethical dilemmas under International Humanitarian Law (IHL). This research article seeks to examine the legality of AWS under the current frameworks of IHL, particularly concerning the concepts of difference, proportionality, and necessity. Key research enquiries will encompass the compatibility of AWS with the fundamental tenets of IHL, any legal impediments associated with their deployment in armed conflict, and recommended regulatory measures to align such technologies with IHL. This research article aims to elucidate the principal legal ramifications associated with AWS, while considering recent academic discourse and prevailing international legal standards. The existing IHL will be evaluated only on its capacity to address the unique issues posed by the utilisation of AWS, as indicated by relevant scholarly literature. Proposals for legal change and international collaboration aimed at placing AWS under competent governance, ensuring it is not perceived as a threat to the humanitarian standards governing armed conflict, will also be evaluated. This paper contributes to the ethical and legal discourse on autonomous warfare, advocating for a framework that upholds human dignity while adhering to IHL.
