Dark Net and Deep Web: Legal Issues and Regulations

The Dark Net and the Deep Web are two parts of the Internet that can’t be found by regular search engines, and thus are good but can also be bad. The potential to provide anonymity and privacy leads to fostering cybercrime, financial fraud, and illegal trade of goods. These characteristics have become arresting priorities for policy and law enforcement aides who need to reconcile privacy legal rights with a mandatory regulation and security. This paper explores legal and regulatory challenges presented by the Dark Net and Deep Web that threaten the sovereignty and integrity of nation, the security of the State, friendly relations with foreign states, public order, decency or morality, or in relation to contempt of court, defamation or incitement to an offense, or to the advantage of any foreign nation, or group of individuals. A comparative analysis of the legal frameworks in India, the USA and the European Union have been done to find the gaps and deficiencies in current legislation and enforcement mechanisms. The key findings and the best practices in responding to Dark Net crime globally have been suggested from the analysis. The paper is a comprehensive study of refined strategy of alignment of international normative standards, utilization of technological innovations, and coordination among stakeholders. The measures suggested in the paper are intended to serve that balance between preserving individual freedoms and curbing illicit activities these shadow networks facilitate. The study aims to draw attention to these important issues, and its aim is to contribute to ongoing efforts to put forth robust regulatory and enforcement strategies.
