By giving an overview of China’s outward investment in Africa and China-Africa BITs, this chapter assesses whether there is any correlation of the number of Sino-African BITs and the total amount of China’s investment flows to Africa. Then, it reviews the evolution of China’s general BITs development and its practice with African countries, in particular, and analyzes the content and salient features of the Sino-African BITs. It found that the Sino-African BITs were signed between developing countries and thus categorized as South-South BITs. This chapter further explores the impact of China’s recent approaches to BITs on future Sino-African BITs, so as to see whether they will lead to a significant shift of China-African treaty approach. Lastly, this chapter briefly discusses the ISDS mechanism by going through the two cases that were brought by Chinese investors against African countries based on Sino-African BITs.
