Child Rights Protection Regarding Safe Learning Facilities in Accordance with the Comprehensive School Safety Framework: A Case Study of Schools in Phan District Areas, Chiang Rai Province

This research aims to study the protection of children's rights concerning safe learning facilities under the framework of surrounding safety in schools under the Comprehensive School Safety Framework (CSS Framework) in Phan District, Chiang Rai Province. This district is located on the Phayao earthquake fault, previously destroyed by a 6.3 magnitude earthquake on May 5, 2014. The perspective applied in this study is the policies and laws of Thailand. Using qualitative research, in-depth interviews were used with administrators and group representatives involved with school design, school construction, and school maintenance in Phan District. The study found that the request for land use in the affected area must be under the Town Planning Act B.E. 2522 (1979). The schools still have buildings constructed decades before the promulgation of the latest 2021 Ministerial Regulations. In addition, the design and calculation of building structures for earthquake resistance in the seismic area at present are under the Ministerial Regulations, which specify load-bearing, resistance, the durability of buildings, and the ground support for buildings in the earthquake resistance (B.E. 2564 (2021) issued under the Building Control Act B.E. 2522 (1979)). Effective school disaster management and education to reduce disaster risk will be the key to Disaster Risk Reduction (DRR) within the school's comprehensive safety framework. Therefore, the Initial Risk Assessment Guide requires a preliminary risk assessment for buildings subject to severe earthquake damage issued by the Department of Public Works and Town and Country Planning.
