The emergence of automated driving systems (ADS) presents both opportunities and challenges. This article explores the shifting risk landscape of automated driving and outlines the regulatory trajectories in China, Germany, the UK, and the US. It contends that the advancement of autonomous driving technology does not equate to full technical autonomy, and thus, automated vehicles should not be granted fully autonomous regulatory status. The article also delves into the regulatory and legislative challenges posed by ADS, focusing on the human-machine interface issue and the resulting liability gaps. It concludes by advocating for a comprehensive regulatory framework to address the unique risks of ADS and to ensure the safe integration of this technology.
