In the scenario of generative AI, multiple liability subjects are involved, including model developers, platform operators, and end users. However, unlike the traditional binary infringement structure of “platform-user” on the internet, generative AI has formed a ternary infringement structure of “developer-operator-user”. Therefore, in the liability chain of generative AI, accurately identifying liability subjects is a prerequisite for determining which laws to apply and how to apply them.
