Lessons Learned from the Case Studies of International Mining and Waste Trade Industries

This chapter addresses the question: What are the key features of a new international framework that can improve the compensatory regime for workers in the South Asian shipbreaking industry? In determining key features, it examines lessons from the civil liability protocols following the Koko and Baia Mare disasters. The liability protocols shifted responsibility from host States of the incidents to the industry in control, making the examination relevant to the shipbreaking industry. Importantly, these protocols provide valuable guidance to shipbreaking industry that implement the civil liability principle and supplement existing international legal frameworks regulating the industry.
