Deficiencies Within the Regulatory Framework in South Asia

Domestic regulatory frameworks are critical in governing high-risk sectors such as shipbreaking. Nevertheless, in Bangladesh, India, and Pakistan’s shipbreaking industries, workers face significant obstacles in accessing legal remedies. The informal and precarious nature of their employment, compounded by the absence of formal contracts and identity documentation, renders these workers unable to effectively invoke national labour laws or pursue compensation for occupational injuries and fatalities. The chapter conducts a legal analysis of the national compensation laws applicable in these jurisdictions, employing a descriptive research methodology, the underlying objective of which is to offer commentary on relevant statutory provisions by elucidating their scope and implementation challenges.
