Disability Rights in India: An Overview of Legislation and Jurisprudence

India’s Constitutional ethos aligns with global human rights principles, championing equality and equal protection for all individuals, including Persons with Disabilities (PwD). The entitlement to a dignified life stands as a fundamental human right, transcending any form of disability. The legislative evolution, notably the PwD Act of 2016, signifies a commitment to ensuring specific rights for the disabled. Recently, a plethora of judicial pronouncements of the Supreme Court of India have marked a progressive step, reflecting an evolving understanding of disability rights. This chapter therefore endeavors to delineate the expanding landscape of disability laws in India, spotlighting the recent amendments in law and discerning the evolving legal jurisprudence in this domain.
