Adjacent Relationships

This chapter defines the legal principles and rules governing adjacent relationships concerning immovable property. Such relationships arise from geographic proximity, either direct or indirect, and involve rights and obligations aimed at reconciling conflicts and promoting mutual interests between neighboring parties. The core of adjacent relationships is the necessary extension of one party’s property rights onto another’s property, creating a conflict between exclusive rights. To optimize land use and ensure benefits, the law imposes a duty on adjacent parties to tolerate such extensions and provide necessary convenience. These relationships apply specifically to holders of immovable property rights, such as owners or usufructuaries, and do not extend to lessees or borrowers.
