The Fourth Generation of Chinese Investment Treaties and Investment Treaty Reform

This chapter examines the broader implications of China’s fourth-generation investment treaties for the ongoing investment treaty reforms. As established earlier, these reforms have been implemented at the national, bilateral, regional and multilateral levels. Within this context, China’s fourth-generation treaties may provide significant contributions to reform initiatives across all levels. The chapter addresses three key questions: (1) how China’s fourth-generation investment treaties constitute an emerging model in the balancing debate at the national level (Sect. 7.1); (2) how China has pursed treaty consolidation at the bilateral and regional levels (Sect. 7.2); and (3) how China has actively participated in multilateral investment rulemaking (Sect. 7.3). The chapter concludes with a comprehensive assessment of China’s evolving role in international investment governance (Sect. 7.4).
