This chapter examines the legal bases of provisional measures in investor-State arbitration. Section 2 analyses provisions on provisional measures in conventions and treaties. Section 3 discusses the rules on provisional measures under the ICSID framework, the UNCITRAL framework and other arbitral institutions. Section 4 compares the differences in the legal bases between ICSID arbitration and non-ICSID arbitration.
