Administrative Regulations: History, Status and Function

This chapter traces the evolution of administrative regulations of the State Council. From 1949, emergency ordinances filled the legislative vacuum left by the abolition of Republican-era laws. During the planned-economy decades, the State Council still issued rules, but without formal statutory power. The 1982 Constitution and 2000 Legislation Law finally granted express authority to issue “administrative regulations”, creating a distinct tier below NPC legislation. It details the historical phases from the birth to the development of administrative regulations, with a special emphasis on translating Party policy into administrative regulation promulgations. It concludes that administrative regulations are indispensable to building a rule-of-law government and modernizing state governance under the CPC leadership.
