Education in Vietnam has been increasingly developed so the demand for cooperation between domestic and foreign investors has also risen. Business cooperation contracts (BCC contracts) have become common in the field of education. However, education today is not only a business sector but also carries the mission of human development. Therefore, an educational BCC contract must balance the economic interests of investors with community responsibility, in which the protection of children’s rights is included. This chapter clarifies certain legal issues concerning educational BCC contracts under Vietnamese law in relation to the right of the child to education in Vietnam and proposes recommendations to improve the legal framework of Vietnam on this matter.
