Chapter 2 provides an overview of trade secrets particularly under Chinese contexts. The chapter considers trade secrets as a type of intellectual property and explains the three requirements of a legally-defined trade secrets. However, this chapter argues that a trade secret is different from typical intellectual property (e.g. patents) in many ways, which may have implications on the antitrust analysis.
