The Rights of Internally Displaced Persons in the Context of Development-Induced Displacement

The frameworks on the rights of internally displaced persons (IDPs), namely the UN Guiding Principles and the Kampala Convention, envisage normative standards and safeguards that apply at all phases of internal displacement. These norms include the right not to be arbitrarily displaced; meaningful participation in the decision-making and process of displacement; human rights protections during displacement; and the possibility of return, resettlement, and reintegration after displacement. As development is one of the prominent causes of internal displacement, these norms can inform the process of development-induced displacement (DID) and the safeguards that need to be provided along the way. Against this background, the current chapter examines the normative standards set out in these frameworks and their contextual application in cases of DID. It also assesses the adequacy of these standards in protecting the rights of persons displaced by development projects.
