Another human right that is commonly interfered with and potentially violated in the course of development-induced displacement (DID) is the right to property. The acquisition of land, the (forced) eviction, and disruption of access to common resources often associated with DID ostensibly constitute interferences with the peaceful enjoyment of property. Studies also evince that DID often leads to landlessness or a decrease in landholding as well as homelessness, which contribute to the overall long-term impoverishment of the people affected that often follows displacement. Such interferences and adverse outcomes can breach the right to property when they are not justified and implemented in line with the relevant human rights standards. This chapter, therefore, examines the extent to which DID interferes with the right to property, how such interferences might be justified, and the rights-based safeguards that must be put in place to prevent violations.
