Children’s Rights and Their Role in Regulating Gambling-like Elements in Videogames

Children are increasingly present in a changing videogame environment, where the convergence of videogames and gambling is one of several evolutions that has taken place. Therefore, it is important to look at the role of children’s rights in this context. Children have different rights that need to be respected when they engage with videogames, for example the right to privacy, the right to play, or the right to be protected against economic exploitation. In addition, different children’s principles related to children’s rights have to be complied with, including the child’s right to development and the right of children to express their views. This chapter discusses the relevant children’s rights framework of the UN Convention on the Rights of the Child and applies it to the topic of gambling-like elements in videogames. The children’s rights perspective is thereby used to evaluate the existing legal framework as discussed in Part II.
