This chapter aims to examine the development of the Responsibility to Protect (R2P) in the international legal landscape and assess the potential of this doctrine to strengthen or otherwise compliment the ICC’s frameworks for responding to non-cooperation. By analysing the elements of R2P that align with the Rome Statute’s provisions on cooperation, this chapter seeks to determine how these principles might enhance the effectiveness of the Court’s current frameworks. Ultimately, the goal of this chapter is to explore how R2P can contribute to a more robust and comprehensive regime for enforcing State cooperation with the ICC, thereby addressing the limitations of existing non-cooperation remedies. This chapter also seeks to highlight the role of R2P in enhancing the United Nations’ collective security mechanisms as tools for enhancing cooperation between States and the ICC.
