The Principle of Congruence and the Quest for the Master Algorithm—How Do These Challenges Affect Law’s Practical-Cultural Autonomy?
摘要
This paper examines challenges in Hans Albert’s legal and social philosophy amid the rise of the “Master Algorithm” (Pedro Domingos), which claims to solve induction problems. It explores two key levels: (1) Epistemologically, the fallibilist trial-and-error method conflicts with the deterministic science endorsed by algorithm advocates, especially Symbolists. (2) Normatively, it questions whether legal and value systems can be reduced to algorithmic, non-normative models in the Second Informational Age, while emphasizing law’s enduring role in shaping communal meaning and resisting full algorithmic assimilation.
