Arbitration is particularly appropriate for the resolution of the controversies which arise in the context of professional sport. Athletes’ careers are commonly short and intense. If a conflict or controversy arises, there is much merit in a swift disposition. Equally important is the resolution before arbitrators who are familiar with the specificities of sport. Team sports, endurance disciplines, governing bodies’ practices, the fight against doping and of course the transfer of players between clubs are all governed by particular norms, some of them traditional and some of them highly technical. Settling controversy before a panel of three well experienced arbitrators is in most cases likely to be swifter and more satisfactory than litigation before a national court. Speed and expertise and confidentiality are normally offered by arbitration. In my experience, there is no special bias in favour of or against a particular interest like broadcasters or leagues or players’ unions.
