Guangxi Guigang Dongfang Shipping Co., Ltd. v. Shenzhen Haianshun Shipping Co., Ltd. et al.

Two ships, M.V. “Heng Hui 15” and M.V. “Dong Fang 223”, collided while inward-bound in the Lingdingyang channel of the Zhujiang (Pearl River) estuary, while taking measures to avoid a third, outward-bound, ship, M.V. “Xiang Fu 8”, M.V. “Dong Fang 223” suffered significant damage as a result of the collision, and officers and crew of that ship suffered injury. Plaintiff, the owner of M.V. “Dong Fang 223”, sued Defendants, the owners of M.V. “Heng Hui 15” and M.V. “Xiang Fu 8”. After considering the evidence, including the findings of an investigation conducted by Guangzhou Shajiao Marine Department, the Court held that M.V. “Xiang Fu 8”, the outward-bound ship, was 55% responsible for the collision between the other two ships, and that M.V. “Heng Hui 15” was 30% responsible and M.V. “Dong Fang 223” 15% responsible.
