Plaintiff consignee Yuandeyu Steel Industry Co., Ltd., purchased a batch of goods, which were transported by M.V. “FU YANG 77” of Defendant shipowner Mingsheng Shipping Co., Ltd. Plaintiff Yong’an Property Insurance Co., Ltd. Yingkou Branch was the insurer of the consignee. The ship collided with M.V. “ZHE SAN YU 55555” of Defendants XU and MAO during transportation, and both M.V. “FU YANG 77” and the goods on board sank to the seabed. Consignee suffered a loss of 9,442,474 yuan as a result (confirmed based on the value-added tax invoice issued by the seller). After the accident, the insurer obtained the right of subrogation after paying the insurance compensation of 8,678,600 yuan to the consignee.
