Plaintiff, CMA CGM S.A, agreed to carry eleven containers containing seafood from Conakry Port, Guinea to Huangpu Port, Guangzhou City. Plaintiff issued a straight Bill of Lading that named Dalian Boyuan Pelagic Fishing Co., Ltd. as the consignee. Upon arrival of the cargo at Guangzhou City, the containers were discharged at the Dongjiang warehouse terminal container yard, operated by Defendant Sinotrans. The consignee discovered discrepancies in the quantity of the cargo in the containers, with evidence of container tampering. The consignee sued the Plaintiff for the shortage in the containers and the Plaintiff, after mediation, paid the consignee the sum of RMB300,000 yuan. The Plaintiff thereafter filed this suit, seeking reimbursement from the, Defendants Nanyang and Sinotrans, the operators of the warehouse and container yard at the port of discharge.
