Plaintiff insurer’s customer, C&D, stored goods in Defendant’s refrigerated warehouse in Tianjin Port. The warehouse was destroyed by an explosion and all of C&D’s goods were lost. Plaintiff, an all risks insurer, indemnified C&D for its loss and brought this claim against Defendant as subrogation insurer. Defendant argued that the explosion was a force majeure event, for which the storage contract excluded liability.
