Plaintiff bank lent a loan to Defendant borrower, and as security the borrower charged mortgages over its owned ships M.V. “Chuan Run 101” and M.V. “Chuan Run 103” in favour of the bank. Also as security for the loan, Defendants YAN, Zhu and XIAO charged mortgages over their co-owned ships M.V. “Chuan Run 105” and M.V. “Chuan Run 107” in favour of the bank, and Defendants YAN and WU provided personal guarantees. The borrower defaulted the loan, and the bank arrested the above-mentioned four ships and sued all Defendants. When the court served the summonses on Defendants, the summonses to ZHU and XIAO were not served successfully, and those two Defendants did not appear in the court room.
