Plaintiff shipowner engaged Defendant insurance broker to purchase insurance for its ship. The insurance broker approached a few insurance companies and found the insurer who was willing to offer the insurance. The insurance broker facilitated the shipowner and insurer to negotiate and conclude the insurance contract. The insurance contract contained a couple of special terms and one of which was that if the shipowner defaulted any of the 4 instalments of premiums, the insurer could terminate the insurance contract.
