Chapter 7 examines how the requirement of certainty affects the enforceability of asymmetric choice of forum agreements. Asymmetric jurisdiction clauses are examined under the Brussels Ia Regulation and the Lugano Convention in the light of the most recent case law of the CJEU. When it comes to asymmetric arbitration agreements, the chapter examines the enforceability of these clauses in the light of the New York Arbitration Convention and the UNCITRAL Model Law.
