The Privacy of Arbitration in Professional Football Contracts in UAE
摘要
This research focuses on the comparative analytical study of the arbitration system in football disputes according to the football regulations in the United Arab Emirates; as the arbitration mechanism is an indispensable means of distancing football disputes from the regular judiciary, and settling them through alternative dispute resolution methods; due to the special nature of these disputes, and it also represents support for foreign investments in the sports field, which always seek to avoid standing before the regular judiciary, as it is characterized—mostly—by slowness and complexity in procedures. I have concluded that the professional football contract has been tightly regulated by the national football associations due to its special legal nature. There are also many legal effects that result from its conclusion; disputes may arise regarding them that must be settled by resorting to the bodies specialized in sports arbitration in accordance with the national regulations and the regulations of the International Federation of Football Association. The study concluded with several recommendations, the most important of which are: quickly activating the powers of the Emirates Sports Arbitration Center, issuing the statute and procedural rules related to sports arbitration, canceling the regulations of the Sports Arbitration Authority affiliated with the Football Association, and being satisfied with the Dispute Resolution Chamber and the Sports Arbitration Center. Also, the text in the Saudi Dispute Resolution Regulations stipulates the right of the foreign professional player to appeal the decisions issued by the local Dispute Resolution Chamber before the International Court of Arbitration for Sports.
