The chapter will examine the key points of European legislation on unmanned aircraft systems. After a brief historical excursus on the steps that have laid the foundations of the European drone policy, the EU regulations will be analyzed. With the basic regulation of 2018/1139 it was established that all drones are subject to the rules on civil aviation safety. To promote investments in the sector, the EU adopted the delegated regulation (EU) 2019/945, amended several times, which establishes the technical characteristics and the capacity that drones must possess to be authorized to fly safely. The regulation also identifies the conditions that third-country operators must respect to operate in the airspace of the single European sky. The implementing regulation (EU) 2019/947 on rules and procedures for the operation of unmanned aircraft identifies three categories of operations: “open”, “specific” and “certified”. The regulation establishes the requirements and procedures to be followed based on the severity of the risk that their use could cause. With a view to implementing the development of the drone industry, in 2020 the EU also adopted regulations on U-space in order to guarantee maximum safety for operations carried out by unmanned aircraft in airspace.
