Overcoming Legal Barriers and Policy Recommendations for Green Public Procurement in the Construction Sector of Iran

The construction sector significantly contributes to the production and release of CO₂, solid waste, and water pollution. Considering that GPP plays a role throughout the life cycle of a construction project and can lead to sustainable environmental outcomes, this research investigates whether GPP has been successfully implemented as a policy within the framework of Iranian Acts in the construction sector. Furthermore, it identifies the barriers to the implementation of this policy in Iran. Utilizing a descriptive and analytical approach, this study outlines the structure of the Iranian legal system and, while emphasizing the non-recognition of public policymaking as a separate legal entity in Iran, examines the position of environmental protection in the Iranian Constitution and GPP in the laws of the construction sector. The main barriers to the implementation of GPP, identified as key findings of this research, include the absence of a recognized right to a healthy environment in the Iranian Constitution, the lack of a roadmap for the implementation of GPP, and the existence of Iran’s centralized and inefficient executive system. This study recommends changing mandatory legislation to reality-based legislation, revising and amending the Iranian Tender Act, and shifting from pluralistic law writing to centralized law writing.
