Legal Frameworks for Protecting Tourists’ Rights: Challenges and Approaches

In recent years, European tourism has faced many challenges, including the COVID-19 pandemic, tour operator bankruptcies and the war in Ukraine. The modern tourism sector is complex and influenced by globalisation, which, together with different national legal systems, pose significant challenges in ensuring equal protection of tourists’ rights across the European Union. This article analyses the legal regulation both in Lithuania and in the European Union. The focus is on organizers, licensing requirements, and mechanisms that safeguard consumer rights. When examining case law, the article draws attention to the uneven application of EU legislation in the Member States. The article emphasizes that simpler and faster ways to deal with tourist complaints on a cross-border basis must be created, and the European Union should carry out initiatives to educate tourists about their rights. Resolving these problems would help prevent violations of tourists’ rights and ensure safe travel between countries. However, this can only be resolved when there is a proper balance between all countries and travelers have a uniform understanding of their rights.
