The Legal Regime of the Accommodation Contract in Spain: Critical Overview and Doctrinal and Jurisprudential Analysis

This work conducts a study on the concept, historical evolution, and the elements involved in the formation and development of the accommodation contract, ultimately focusing on the current situation regarding the liability, towards clients, of the administrators of establishments dedicated to tourist accommodation within the framework of current civil law -that is, within the accommodation contract- as well as the most common legal conflicts that may arise in this field. In summary, in Spanish law, an accommodation contract is defined as an autonomous, mixed and atypical contract by which a person, a professional in the hospitality industry, undertakes to provide accommodation to another person for a certain period of time, possibly by providing food for a certain price.
