The legal issues and challenges of medical tourism are one of the fastest growing issues and are receiving increasing attention. Medical tourism involves individuals traveling abroad to receive medical services such as surgery, cosmetic procedures, diagnostics or even dental treatment. This trend is growing rapidly worldwide for a variety of reasons, such as high quality services at significantly lower prices or even the availability and permissibility of specific treatment methods. Despite its obvious advantages, medical tourism also raises a number of legal liability and regulatory issues. All of this can have a significant impact on the interests of patients and healthcare providers. One of the main regulatory problems in this area is the different national legal systems and their incompatibility. Each country has its own health legislation, which can be very different from other countries. The main documents and challenges analyzed in this paper have shown that individuals are not sufficiently informed about the protection of patients’ rights, as well as about the standards of quality and safety of healthcare services. The aim of the paper is to discuss the main legal challenges related to medical tourism. It also suggests possible solutions to more effectively protect individuals and to ensure legal compatibility between countries.
