This study is situated within the realm of cosmetic medicine, a field that has seen significant advancements in recent years, particularly with the integration of digital tools and technologies driven by artificial intelligence. The paper examines the factors influencing medical malpractice in cosmetic procedures, focusing on how technological innovations, specifically AI-assisted surgery and digital imaging, affect the outcomes of these procedures. It assesses the circumstances under which civil liability may be imposed on surgeons, including instances of technological failure or erroneous recommendations from AI algorithms, as well as the conditions that allow an injured patient to seek compensation. Additionally, this analysis will facilitate the monitoring of legislative trends related to medical errors, taking into account the rapidly evolving nature of innovations, to identify potential sources of error arising from AI or digital technologies. Furthermore, the research outlines the civil responsibilities of cosmetic surgeons, emphasizing the necessity for due diligence when implementing new technologies.
