Ukraine’s Constitutional Court: The Performance of the Court and Constitutional Law Jurisprudence Before and After Russia’s 2022 Invasion

This chapter analyzes the legal and political role of the Ukrainian Constitutional Court before and since Russia’s large-scale invasion of Ukraine in February 2022. While the issue of constitutional jurisdiction in Ukraine has gained increasing attention following the Euromaidan events of 2014, there is a lack of comprehensive academic coverage of the politics of judicial review in Ukraine. This is surprising, as constitutional courts occupy a key position in shaping the balance of power between the legislature, executive and judiciary. This chapter provides an empirical assessment of the effectiveness and influence of the Constitutional Court in addressing power politics, Europeanization and socio-cultural issues, e.g., language policy and decommunization, over the last decade.
