Digital Technologies and the Right of the Defendant to Silence: A Legal Study in Light of Technological Advancements in Criminal Justice
摘要
This research paper tackles the topic of “Digital Technologies and the Right of the Defendant to Silence: A Legal Study in Light of Technological Advancements in Criminal Justice, ” making clear that, due to various factors that could influence the defendant, the right to silence remains one of the paramount protections against any such influences that may entrap them into self-incriminating statements. The research will investigate supposedly modern technological innovations regarding audio and video recording and polygraph devices which can protect this right better or worse after recent amendments to criminal legislation. The ruling emphasizes that sufficient legal protection must be established so that no coercive or unlawful inducements are made against the defendant. It also emphasizes a pertinent need for all forms of technology, which might aid in manipulating or coercing persons charged with crimes to be banned. This research is a key part in understanding how to keep the right to remain silent as criminal laws change, focusing on the rules and protections needed to uphold it. The work highlights the importance of having strong legal steps to stop any illegal forces on the defendant while also dealing with the effects of new technology, like polygraph machines, on using this right; it argues for a ban on any methods that might be used to pressure or wrongly sway the defendant.
