Technological Development and the Crime of Threat: Digital Protection and the Exploitation of Legal Loopholes

This research investigates the crime of threat within the context of technological progress, emphasizing its definition, components, and both legal and societal ramifications. It delves into the essential elements of the crime of threat, which encompass the material element, indicated by the means of the threat; the moral element, reflecting the perpetrator’s intention to induce fear or cause harm to the victim; and the legal element, which requires statutory provisions that criminalize this behavior and establish suitable penalties. The analysis includes a review of the most significant types of threat-related offenses, such as verbal and written threats, along with threats that involve physical means like weapons or extortion. Two primary categories of threats are particularly underscored: threats of murder, recognized as among the most serious and subject to stringent legal repercussions, and threats of theft, utilized as a method of extortion to compel individuals to relinquish their property or make certain decisions. Another major contemporary study is the cyber threats, which were one of the most hazardous kinds of threats in modern environments. The present modern technology which has brought several crime avenues through email systems, social media, and messaging applications is difficult to manage and capture offenders. It discusses how technology serves as a channel via which these crimes are committed, studying electronic hacks, personal information misuse, and digital masks that open up extremely threatening and complex threats, because it multiplies their severity and complexity. The present paper will further analyze the legislative support proximate to the criminalization of the offense of threat in Arab laws, thus making a comparison of the legal enactment among the varied Arab nations, to see the differences and similarities in terms of punishment and legal actions. This paper will also identify some gaps in the law that have been used by the offenders and give some recommendations on improving the legal frameworks and the protection strategies to counter the evolving threats that are being witnessed in cyberspace.
