Emerging technologies such as the Internet of Bodies (IoB), neurotechnologies, and algorithmic clinical systems are reshaping the epistemic foundations and ethical contours of modern healthcare. Their integration into diagnostics, treatment, and monitoring introduces new paradigms of embodiment, datafication, and actuation—where biological processes are rendered intelligible, modifiable, and responsive through digital means. While these systems offer unprecedented opportunities for precision medicine, real-time intervention, and patient-centered care, they simultaneously challenge foundational legal concepts such as autonomy, consent, and proportionality. Conventional compliance frameworks—grounded in post-hoc control, sectoral regulation, and static definitions of personal data—are increasingly ill-equipped to govern technologies that operate continuously, inferentially, and across disciplinary and jurisdictional boundaries. This chapter explores the legal and ethical vacuum surrounding next-generation healthcare technologies, arguing for a recalibration of governance models to address their embodied, anticipatory, and potentially irreversible nature. Drawing from developments in Swiss and European data protection law, human rights jurisprudence, biomedical ethics, and algorithmic accountability frameworks, it outlines the limitations of existing norms and proposes a composite governance paradigm rooted in anticipatory regulation, adaptive compliance, and digitally literate ethics oversight. Emphasizing institutional accountability, democratic scrutiny, and the preservation of cognitive liberty and bodily integrity, the chapter offers a future-oriented blueprint for aligning technological innovation with public legitimacy, legal coherence, and the evolving ethics of human-machine integration in healthcare.
