This chapter provides the legal history of informed consent in health care. Important cases like Pratt v. Davis and Schloendorff v. Society of New York Hospital shed light on the need for informed consent while later cases including Allen v. Harrison elucidate disclosure requirements. Davies v. MultiCare Health System puts some limits on what courts see as necessary disclosures. This legal history speaks to the reasons for informed consent and provides context to the issue of whether to disclose the use of AI.
