This chapter is dedicated to three foundational points which will be relied on in the following chapters. The first concerns the identification of the actor: it is important to distinguish the controller of the avatar and the avatar itself. The second pertains to the identification of the ‘act’ in virtual reality. I will argue that individuals can, and regularly do, perform actions in virtual reality and that these actions can form the basis of a criminal offence. This chapter will then conclude with a short discussion of the wrong at the core of sexual offences. Although it notes the ambiguity surrounding the term ‘autonomy’, it concludes that the term ought to remain a central focus of the current analysis due to its increasing recognition and establishment as part of the wrong at the core of sexual offences both domestically and internationally.
