Ethical Threats in a Post-truth Era: Propaganda, Artificial Intelligence, and Coercive Control in the Legal Profession

Through a discussion of three areas of ethical threat: propaganda and disinformation, AI and deepfake manipulation, and coercive psychological control, this chapter makes the argument that changes to American legal education principles and practice must be urgently made. It argues that the type of training required should encompass several key areas, such as the ability to recognize propaganda, information verification, and cognitive bias awareness skills. It is also argued that law students must develop a deep understanding of the psychological and strategic mechanisms underlying modern disinformation campaigns. The importance of such changes extends beyond providing more robust preparation and training for new lawyers. It is strongly argued that the integrity of the law and apparatus of the legal system itself are also at stake.
