Free Speech Coalition, Inc. v. Paxton: Sexually Explicit Speech Online and Age Verification

The internet has led to revolutionary changes in commerce, political discourse, and media communications. It has also led to the proliferation of pornography online. This has resulted not only in consenting adults having greater access to produce and view sexually themed expression; it has also raised serious concerns about children’s access to pornographic materials. These competing concerns of protecting First Amendment rights for adults and safeguarding children from harm were the matters litigated in Free Speech Coalition, Inc. v. Paxton. In that case, the US Supreme Court upheld a Texas law that requires commercial websites publishing sexual material harmful to minors to verify that users are at least 18 years of age.
