Introductory Aspects on Human Rights Law in Mauritius

It is indubitable that colonial history had a significant impact on the normative and institutional framework on human rights in Mauritius. Both French and British colonisation influenced discourses and narratives on human rights to a significant extent in Mauritius. This chapter attempts at capturing the essence of the above. It then provides for an overview of the 1968 Constitution and its cardinal principles relevant to human rights in Mauritius. Chapter 2 of the Constitution, referred to as the bill of rights, is discussed from the perspective of its enforceability and the extent of its permissible derogation. Lastly, the chapter focuses on the National Human Rights Commission as the quasi-judicial institution in Mauritius with a promotional and protective mandate regarding human rights.
