Mechanisms for the Enforcement of Consumer Remedies for Faulty Goods in Ghana

This chapter critically evaluates the adequacy of current mechanisms for dispute resolution between traders and consumers concerning faulty goods in Ghana. The analysis reveals that the present court forum as the sole avenue for the resolution of consumer disputes is not easily accessible to most consumers due to the complexities of the court processes and the high cost of litigation. Similarly, the analysis showed that the limitations of present court-connected Alternative Dispute Resolution (ADR) models are equally out of reach to the average consumer in Ghana. The inadequacies of the mechanisms for dispute settlement are further considered in the next chapter of this book, drawing inspiration from the approach of English law, as influenced by the EU. The comparative discussion in the next chapter aims to identify lessons that are tailored to the specific circumstances in Ghana.
