The Common European Asylum System and Non-Refoulement

This chapter details the sources and hierarchy of EU and ECHR law, including what the process of claiming asylum in the EU would entail. EU law is distinct from ECHR law, in that the former is a set of laws which binds EU Member States, while the latter binds Council of Europe Member States. EU law includes EU primary law such as treaties and EU secondary law such as directives and regulations of the CEAS. ECHR law is the law that is interpreted and applied by the ECtHR and the provisions within the ECHR.
